Terms and Conditions of use for SEEmySEA

By registering with this site you signify your acceptance of these terms and conditions and of those of the members' code of conduct.

OBJECT OF SEEMYSEA.COM

SEEmySea.com is a web site of boat exchange between private persons which establishes matches among swap proposals from boat owners wishing to exchange and which proposes some services to assist them during the preparation of exchanges.

RISPONSABILITY IN CASE OF BOAT EXCHANGE

SEEMYSEA.com is not the representative/proxy of boat owners. Therefore, it is not liable for any unsatisfactory boat exchange, whatever the reason, or for any damage caused to boats and equipment during exchanges.

The members' code of good conduct recommends that exchange partners communicate to each other their respective insurance policies, boat and third party. It is also strongly recommended to inform one's insurer of the exchange, in details, and subscribe for any complementary insurance covering any circumstance related to boat exchanging.
No situation, no prejudice, caused by the absence of proper insurance among exchange partners, can engage the responsibility of SEEMYSEA.com.

SEEMYSEA.com does not have to verify the sailing/navigating competency of its members. It is not responsible for any damage on boats exchanged or prejudice to third persons caused by mistakes, carelessness or navigation errors.

SEEMYSEA.com activities consist solely in listing some exchange proposals and cannot be held responsible for any theft perpetrated at the occasion of any boat exchange.

Advice and services proposed on top of searching and reading exchange proposals are present on this site solely for informative purpose and do not oblige members in any manner. Their authors will not entertain claims about them.


LIABILITY IN RELATION WITH THE USE OF THIS SITE

SEEMYSEA.COM cannot be held responsible for problems arising from users' wrong handling of data and technical problems of any kind.
SEEMYSEA.COM is not responsible for any problem of access to this site or up/downloading problems caused by a faulty server.
SEEMYSEA.COM is not liable for potential defamatory/libellous, obscene or racist postings by some members nor for prosecutions which could be initiated against these rude members.

LEGAL NOTICE, DATA PUBLISHING

In accordance with the law "Informatique et Libertés" in force since the 6th of January 1978, members enjoy a right of access, correction, modification and deletion of the data related to them.
Information on names, particulars, addresses and email addresses, communicated by members when they subscribe, are strictly confidential.
Email addresses are accessed solely by registered members and those that wish to remove theirs can do so at their convenience.
Data supplied by members are not communicated to other organisations or agencies and email addresses are protected against spamming, as long as it does not come from a member, in which case it should be brought to the attention of SEAMYSEA.com so that the trouble can be ceased.
SEEMYSEA.COM cannot be held liable for the content and/or the accuracy of members' proposals or photos.
SEEMYSEA.COM cannot be held responsible in any manner for disputes between exchange partners. Descriptions and photos are the sole responsibility of those who post them.

INVOICING CONDITIONS - MODE OF PAYMENT

All payments must be made to SEEMYSEA.com via the secured payment system choosen by the data bank producer. Thus, SEEMYSEA does not get to know of the users' banking particulars.

Only immediate payment is allowed with no exception whatsoever.

Parties agree that they have entered into a contract as soon as an offer has been posted and as long as the terms of the contract comply with the stipulations of article 1134 of the French civil code.

Any past or future other or contrary conditions, inserted into their informative material, correspondence, invoices or contracts, from our contracting parties will be deemed void even in the absence of protest from our side.

The act itself of subscribing signifies the acceptance of these general sale conditions which automatically render void any contrary clause.

DOMICILIATION AND PLACE OF LITIGATION

For any claim arising at the occasion of formulating, accepting and executing our contracts, whatever the place of subscription or payment, only the courts located in the country of our registered office will have competence, even in the case of guarantee appeal or of plurality of defendants.

This contract is subject to French law.
